If an ARC doesn’t respond to a properly submitted request within the timeframe set out in its own governing documents, Florida law provides a real default protection: the request can be treated as automatically approved, a position courts have upheld when committees miss their own stated deadlines. Properties inside a designated historic district, or individually designated historic structures, need a Certificate of Appropriateness (COA) for exterior work — a review focused on whether new materials, colors, massing, and design details are compatible with the district’s historic character. Sequencing HOA/COA review with the building permit.
These private and quasi-public approvals typically need to happen before, or in close coordination with, the building permit application — and some building departments will actually require documented HOA or historic board approval as part of the permit submission package for properties subject to either.
