Why South Florida's codes are different.

South Florida’s building codes are not the national standard — they’re a direct response to Hurricane Andrew and the decades of storms since. Miami-Dade and Broward counties sit inside Florida’s High-Velocity Hurricane Zone (HVHZ), the strictest wind-resistant construction standard in the country, where exterior products like windows, doors, roofing, and garage doors generally need a Miami-Dade Notice of Acceptance (NOA) or an HVHZ-rated statewide product approval to pass inspection. Palm Beach County sits just outside the HVHZ boundary but is still governed by demanding wind-load and wind-borne debris requirements under the Florida Building Code. Layered on top of that, permitting isn’t handled by one office — Miami-Dade, Broward, and Palm Beach counties each run their own building department for unincorporated areas, and most cities within them run separate departments with their own submission processes, fee schedules, and review timelines. A property near the coast or in a flood-prone zone adds another layer: elevation requirements and, for larger renovations, Florida’s “50% rule,” which can require an entire structure to be brought up to current flood-elevation standards if the cost of improvements is high enough relative to the building’s value.

How the process actually runs.

The permit process itself follows a fairly consistent arc, even though the specifics vary by jurisdiction. It starts with a complete set of construction documents — architectural floor plans, structural or engineering drawings where applicable, and specialty documents like energy code compliance forms or product approvals. Those documents get submitted to the relevant building department, where a plan reviewer checks them against the Florida Building Code, local zoning rules, and, in HVHZ areas, wind-load and product-approval standards; a straightforward residential remodel might move through review in a matter of weeks, while anything involving structural changes, additions, or flood-zone compliance can take considerably longer. Once the permit is issued, work proceeds through a series of scheduled inspections tied to construction milestones — typically foundation, framing, rough-in (electrical, plumbing, mechanical), and final — and the project closes out with a Certificate of Occupancy for new construction or a change of use, or a Certificate of Completion for most renovations to an existing home.

What happens if you skip it.

Skipping or mishandling this step doesn’t just risk a fine — it can undermine the entire renovation. Building departments can issue a stop-work order the moment they discover work happening without an active permit, halting the project mid-stream and sometimes requiring completed work to be opened back up for a retroactive inspection. Unpermitted work also follows the property: it has to be disclosed to buyers at resale, it narrows the pool of buyers and lenders willing to touch the property, and if damage is later traced to work that was never inspected, an insurance carrier can deny the claim outright or decline to renew the policy.

1 Do I actually need a permit to renovate my kitchen or bathroom, or is that just for additions?

Most structural, electrical, plumbing, and mechanical work needs a permit, even inside an existing kitchen or bathroom — that includes moving walls, relocating plumbing or wiring, and structural changes. Purely cosmetic work generally doesn't, but the line moves by city, so confirm before starting.

2 How long does it actually take to get a permit approved in South Florida?

It depends heavily on jurisdiction and project — a straightforward remodel might clear review in a few weeks in some cities, while structural changes, additions, or flood-zone requirements can take considerably longer, especially with revisions.

3 What actually happens if I skip the permit and just do the work — will anyone find out?

More common than expected — through a neighbor complaint, an inspector noticing while reviewing an unrelated permit, an insurance inspection, or when you try to sell. A building department can issue a stop-work order and require opening finished walls for retroactive inspection.

4 If I sell my house later, does unpermitted work actually matter to a buyer?

Yes — Florida sellers must disclose known unpermitted work, and it surfaces in title searches and appraisals anyway. It narrows your buyer pool, can complicate financing, and frequently becomes a costly negotiating point at closing.

5 What's the difference between getting a building permit and getting HOA approval for a renovation?

Two separate approvals: a building permit is a legal requirement confirming the work meets the Florida Building Code and zoning rules; HOA approval is a private, contractual requirement confirming the work meets community design guidelines. If you have an HOA, you typically need both.

6 What does it mean if a window or roofing product has an NOA — is that the same as passing inspection?

An NOA (Notice of Acceptance) is Miami-Dade County's product approval confirming a specific product has passed HVHZ testing. It's a prerequisite for using that product in Miami-Dade or Broward, but installation still has to be inspected and approved separately as part of your permit.

7 Does the contractor pull the permit, or am I supposed to do it as the homeowner?

In almost all cases, the licensed contractor performing the work pulls the permit under their license, making them legally responsible for code compliance. Florida does allow homeowner "owner-builder" permits on a primary residence, but that shifts all legal responsibility onto you personally and is meant for work you're actually doing yourself.

8 What drawings or documents do I need to have ready before I can even apply for a permit?

At minimum: complete architectural drawings showing existing and proposed layout, a site plan or survey, and, for anything touching the structure, sealed engineering drawings and calculations. Depending on scope, also energy code compliance documentation and HVHZ product approvals.

9 What is a Notice of Commencement, and when do I actually need to file one?

A Notice of Commencement is a recorded legal document that puts your project on record before work starts — it's a statewide requirement under Florida law, not something unique to any one county, and it applies once your direct construction contract exceeds $5,000. There's a specific carve-out for HVAC repair or replacement work, which only triggers the requirement above $15,000. Recording it isn't optional paperwork — it protects your right to enforce the contract and factors into how liens against the property can be filed, so we handle it as a standard part of getting a project properly underway, not an afterthought.
